other for.quite some time.when can I file a protective order I can.file protective order if there's been.any kind of abuse to me what is abuse.under our state our protective order.statute in Maryland abuse is a.second-degree assault.in other words any kind of assault.somebody touches you without your.consent whether it's a punch in the.mouth whether it's a push whether it's a.spit.that's a second-degree assault you can.call the police and have that person.removed and you can file a protective.order and have them removed threat of.imminent bodily harm so the person.didn't hit me.but they were yelling and they were.screaming and they were making armed.gestures and they were throwing things.against the wall and I was scared for my.life you can file for a protective order.you should call the police.and then go to court and file protective.order there are other grounds as well.there's certain grounds for harassment.or trespass or sexual abuse things like.that if any of that happens to you if.you get abused in any way you call the.police you file for protective order a.peace order is a little bit different.it's for people who usually are.neighbors you know keep the peace its.neighbors who are encroaching on each.other's property who are screaming each.other or it's ex-boyfriends and.ex-girlfriends who want them to stay.away from each other that kind of thing.or ex-spouses you file a peace order the.same grounds as protective order apply.to a peace order although there are some.slight variations so if it happens you.call a lawyer you just simply call the.police and say this is what happened I.want to go up to the courthouse I want.to go to the commissioner and file for a.peace order so what do you do when.you're in this situation what does to call the police that.doesn't mean it didn't happen.and judges and lawyers understand that.so if anybody tells you well you waited.a week so you can't file now that's not.right if anybody says well of.you are gonna go in front of a judge and.if one of you says it happened and one.of you says it didn't happen well if you.want to have one of you has witnesses or.other evidence that you can prove that's.what the hearing is for so you have one.week where the orders going to be in.place and then you're going to go in.front of a judge and you're gonna and if.you can't agree on a consent order a lot.of times people will get to court and.they'll say all right you know I've had.enough I don't want to stay here anymore.I want to consent without a finding of.abuse I want to move out this is what.I'm going to do people do that.frequently and judges encourage that but.if you can't reach an agreement you're.going to go in front of a judge you're.going to put on testimony and it.judge is
