A contractor works on a contractual basis, arranging deals with multiple clients to work on specific jobs or projects. The work that falls under the contract exists in numerous industries, but one of the most common industries for contractors to work in is construction.

Though contractors work for a company, they are not under employment; instead, they work through an agreed contract for a fixed period. They work on their own and sometimes for an organization.

For which Forms you Need to Hire a Contractor?

Below enlisted forms are some of the forms that require people to hire a contractor.

Form W-9

The contractors need to fill out a Form W-9, Request for Taxpayer Identification Number, and Certification, which they are supposed to keep for at least four years after the hiring.

This form is utilized to request the correct name and Taxpayer Identification Number, or TIN, of the employees or their entity. A TIN can be a Social Security Number (SSN), or an Employer Identification Number (EIN). Just ensure that the contractor checks the box that excludes him from tax withholding.

A Written Contract

A contract should be made by an attorney and highlights the project and its projected results, the project fee, and the date of results. The contract should also have the below things clear:

The client will not pay or hold back taxes or benefits contributions.

The contractor will use their expertise and tool to complete the project.

The client may end the contract in case he or she is not satisfied with the work, or he violates the terms of the agreement.

Form 1099-MISC

Apart from a few exceptions, in case you pay the IC $600 or more for services given all the year, you must give your contractor with Form 1099-MISC. Mostly January 31st is the due date that your company requires to have sent the 1099 form to its receiver. For electronic delivery, a company requires to have delivered the email to the receiving and forms them that their form has prepared.

Invoices

Just make payments against the invoices that have been submitted. No need to receive expense reports. Tools, mileage, and other related items form part of the contractor’s business expenses, not yours. File all invoices, and make sure that they interrelate with Form 1099-MISC.
