to.justice initiative to assist people in.doing electronic filing with the EDM s.system in the Iowa courts I very much.believe in small claims court as the.People's Court you don't need a lawyer.to represent yourself either if you're.suing or being sued but even though the.procedure is simplified the same law.applies as in the regular trial court.and even the procedure for small claims.can be confusing and complex if you're.not used to it so what I'm trying to do.with this is to give people some.assistance this is not a substitute for.having an attorney.you know I undoubtedly will be you know.making mistakes or miss stating things.also it's going to depend on your.individual case but hopefully what this.is going to do is give you a visual and.that recording you can actually see how.to go ahead and register with EMS and.then how to start a case and that lease.get you started and give you a push.forward so you can start learning this.on your own because if you're able to.you know work in small claims court and.represent yourself it's almost like a.superpower it really is a very.empowering experience and you know you.at that point don't have to be worried.about not having a lawyer you can you.can go ahead and defend yourself or do.the case yourself so for the past couple.years all filings in the Iowa courts.have to be done electronically it's it's.technically you can do a paper filing.but in practice what you're going to do.is if you go to the courthouse they're.just going to set you up just like I am.now.with an e dms account and then scan it.help you scan the stuff so you really.want to take advantage of the electronic.filing and if you can't do that you're.really cutting yourself off from access.to the courts but it's really pretty.straightforward what you're that I mean it's your.it's on you to monitor your account and.to make sure that you know what's going.on the filings so that's very important.as you guys you go through this okay so.goodness is saying I agree and submit to.this then what you're gonna do is choose.the role that you're playing here the.for the most part if you're representing.yourself you're gonna be here check your.registered filer now keep in mind that.unless you're an attorney generally you.can't represent other people so if you.have a daughter or you know your son or.a friend of yours or you have a you know.your your parents or something there are.elderly if they don't want anything to.do with the case you're gonna need to.get an attorney now you can certainly.help them out with it you can you can.you know help them fill things out but.you know when it comes to court and as.far as doing the filings that they need.to be doing that and I mean you can sort.of do it in their name electronically.but when you get to court they're going.to need to be representing themselves.now the exception to that is in certain.situations if you're if you have a.corporation or a business for example if.you own an LLC or something you can show.up and and represent the LLC if you're.the owner also in a landlord-tenant.situation the landlord the owner of the.property doesn't have to show up the.management company or an employee of the.management company can actually do the.case either for an eviction or for.damages.on behalf of the of the owner of the.property but for the most part you gonna.be registered file here and select that.and then you go to the you can see they.say pro se pro se is a legal term that.means you're representing yourself then.you need to fill out all these asterisks.indications here those are required and.the it's also useful to give the.additional information if you can phone.numbers actually so it goes like.occasions you know that can be very.useful information default County you.might want to put that in there I would.be Johnson County and you say submit and.they don't do test one so I can't do it.this way but my recollection is that.they just you know set you up and send.you an email and then you're all set up.and make sure obviously that you write.down that username and password that.you've chosen and and then you know be.careful about keeping track of that.information so you don't lose it okay so.once you're registered with them and set.up then then you can go to the you can.start logging and when you need to so.you could this is my account it's my my.username and then my password so I just.log in and this is the main kind of page.as far as accessing all the various.things that you can do as a filer now.some of this may be a little different.because I'm an attorney but hopefully it.won't be that different and you'll be.able to you can follow along with it on.your own the registered filer thing so.one of the things here is that you can.under my cases get that button and if.you you have one or more cases going.it'll they'll show those cases there's.the name of the case here's the case.number what type of case it is what.county it's in and then what you can do.is if you hit this little plus mark here.then this shows all the pleadings that.have so far been filed in the case and.if you want to take a look at one of.those pleadings you know for example.here's an exhibit in the case you can.open it up and then with your PDF reader.so I just pick my PDF reader there and.then you can take a look at it that's an.exhibit you can see the filing here it.was filed on the date.on the blue line at the top there with.the clerk of the Johnson County Court.okay so let's go ahead and go back to.home here and go ahead and file a new.case and I'm gonna basically just walk.you through the process of doing that.this is gonna be for a small claims case.ok case types small claims anything else.you don't want to be doing you know it's.small claims is tough enough trying to.to do those cases okay so the types of.cases okay normally in a small claims.case I'm gonna explain today how to do a.money judgment money judgment is a case.where you asking for money damages small.claims you can only get money damages.and up to sixty five hundred dollars and.then a very limited number of other.things so for example if you came and.you said I want to order that so-and-so.stays away from your something like that.that's not somebody can get in small.claims the small claims court does not.have the jurisdiction to handle that the.other thing that you would potentially.be doing as small claims would be an.eviction if you're a landlord or you had.a tenant that's what this forcible entry.here those are actually very very.complex and if you've never done before.I would recommend getting an attorney.that's something that I I handle as well.but but a money judgment certainly is.something you can handle yourself.okay so let's click money judgment and.this is the what they call the.electronic cover sheet now you picked.the county now in terms of the county.what you're going to want to do is the.person who files the case is called the.plaintiff they're the one of the.complaint and then the person defending.the case is the defendant and the way.things work in Iowa are that you.generally need to sue the defendant in.the county where they live and the.exception to that would be a situation.where you had a contract and that was.meant to take place in a particular.county or where the damage damage that.took place in a picker County so for.example if you rented an apartment in.Johnson County and you didn't get your.security deposit back you could sue the.landlord here in Johnson County district.court and the small claims division so.check the county the case title is.the name of the case and the name of the.case is the name of the plaintiff in.this case the example is going to be.John Doe and then you always put if.there's multiple plaintiffs you put.their names then V means vs. and then.the Richard Roe okay here's the example.we're gonna use and then Sam Smith is.also the second defendant now if you.have a lot of defendants what you can do.is to say at all if you can't you don't.have room for their names in there you.can at all and that just Latin.abbreviation for and others but if you.can you want to list the names of.everybody in the case and so the prayer.amount is how much you're asking for as.damages small claims if you ask from.well there's $5,500 you're it's you.can't do it in small claims so it needs.to be sixty five million dollars or less.it's not unusual for people to sort of.just every time they do a small claims.case - there's sixty five hundred.dollars don't do that unless you.actually have a valid claim for $6,500 I.mean put in the amount of money that you.have a valid claim for I mean you don't.have to undercut yourself but at the.same time and I think that the prayer in.this case was forty five hundred was my.recollection for my my sample petition.that I was gonna be using so then we're.gonna add my parties okay so your.parties in this case you the plaintiff.if you're filing the case so you're.gonna put your name in here so we're.just gonna go ahead and put John Doe and.you need to put at least one of these.indications in here either the either.social security number or driver date of.birth the court is not public.information they'll keep it confidential.but they need that information in order.to make sure that there's more than one.person with your name to make sure that.they don't get it mixed up so in their.system they need to have a unique.identifier for you so let's just let's.just do so this make up a sole security.number.okay and then the address here is it's.just again this needs to correspond I'm.not gonna worry about this to what's on.the petition but I'm just gonna okay so.City Iowa City here cities Iowa City and.they'll check if you get the wrong zip.code so make sure you get the zip code.right they'll check that with the city.okay so next okay so you can see or it.pops up John Doe plaintiff and because.I'm an attorney at pops this is Warnock.but that won't be in there for that now.other parties like I said we've got.these are defendants we've got two.defendants Richard Rowe and like I said.I'm not sure exactly what we're just.going to make these up.okay so next okay so we got the.plaintiff you got the defendant let's.just go ahead and take that we're not.gonna again you you you you need to make.sure that what's the information you're.adding in here corresponds to the.petition that you file so be careful to.make sure that all the the information.you enter corresponds to the and it's as.accurate as possible okay so we have.here a plaintiff and defendant okay so.now we're at the point at which we would.be filing the documents so if we just go.up to here to small claims common.filings okay.and then document type is gonna be.[Music].let's see your small claims original.notice that's see small claims that.original notice that's what you want to.file okay so that's what it's small.claims original notice and petition so.that's the petition original notice is.the document so then what you're gonna.do is do a browse here and I actually.have a petition set up on my desktop.here it's John Doe petition okay so I'm.gonna open that see and then you add.okay now what you can do here is in a.small claims case we're doing a money.judgment you can try to get the part it.parties the opposite parties to be filed.by certified mail so just click that and.that's you can do that in Timonium but.you can't do it in an Fe D and an.eviction okay so then let's hit next.okay so you can see here's the petition.and if you want to take a look at it.here we just hit this petition and let's.just take a look at the in the petition.what it looks like okay now this is a.fillable form i took the the basic.electronic form and i put a bunch of.fields in it so you could actually fill.it out and you can see here I've got.John Doe and is in the address and then.and this one is set up for two.defendants and it says notified.4500 dollars and then at just a brief.explanation nice I put here tenants were.defendants were tenants of plaintiff.moved out without paying two months rent.so two times fifteen I'm that's three.thousand and did fifteen hundred for the.damage after subtracting the deposit so.the total of heath that the plaintiff is.saying they owe is three thousand plus.fifteen hundred or forty five hundred.dollars okay and then you see John Doe.here at the bottom and then his address.phone number and email those are all.required so that's what you need to do.for that okay so then the next thing you.do hit next and then at the bottom here.yeah now the plaintiff needs to pay.eighty five dollars for the filing fee.and then ten dollars for the certified.mail okay so basically need to pay by.credit cards you pick that John Doe pay.by credit card and then when you hit.submit the filing here and I'm not going.to do this because I don't want to end.up getting charged you're having a.problem or having this go through you.said this submit the filing then you get.to a page that has all the credit card.information you fill out your credit.card information and then you submit.that and then you come back to a page it.looks like this and it says that that's.been submitted so then what's going to.happen is it'll get sent to the court.and the court is going to review it.and if there's any problem they're gonna.kick it back to you but you know and.they'll explain what the problem is you.know with the filing now what you want.to do is if you follow the instructions.that I had and use the fillable form.just make sure all the information is.accurate and then it's a corresponds the.information you entered corresponds to.what's on the petition then what will.happen is if it gets approved you get an.email saying it's approved and then you.can go look here if you look at.notifications there's actually.instructions on the email if you look at.notifications and then you go to under.it'll say that you know petition and.original notice you hit this button here.and there's a special version of that.with it filed with the blue line on the.top like you can see and then there's an.additional page with the courts that's.that's added to it that the court has.had a filing page and accepted it with a.court seal on it that's what you need to.print out and if you're gonna keep a.copy now if if the service works if they.pick up the certified mail you're set.and the court was just going to go ahead.and set a hearing in that case either.they'll answer or they'll be a default.and get a hearing if they don't pick it.up then you have to service who the.sheriff but there's all sorts of.permutations but this is the basic way.that you fill it out this is how these.are On your airport customs forms, the "boxes" that you 'need' to write on - are basically invisible to the scanner - but are used because then us humans will tend to write neater and clearer which make sit easier to recognize with a computer. Any characters with less than X% accuracy based on a recognition engine are flagged and shown as an image zoomed into the particular character so a human operator can then say "that is an "A". This way, you can rapidly go through most forms and output it to say - an SQL database, complete with link to original image of the form you filled in. If you see "black boxes" at three corners of the document - it is likely set up for scanning (they help to identify and orient the page digitally). If there is a unique barcode on the document somewhere I would theorize there is an even higher likelihood of it being scanned - the document is of enough value to be printed individually which costs more, which means it is likely going to be used on the capture side. (I've noticed in the past in Bahamas and some other Caribbean islands they use these sorts of capture mechanisms, but they have far fewer people entering than the US does everyday) The real answer is: it depends. Depending on each country and its policies and procedures. Generally I would be surprised if they scanned and held onto the paper. In the US, they proably file those for a set period of time then destroy them, perhaps mining them for some data about travellers. In the end, I suspect the "paper-to-data capture" likelihood of customs forms ranges somewhere on a spectrum like this: Third world Customs Guy has paper to show he did his job, paper gets thrown out at end of shift. ------> We keep all the papers! everything is scanned as you pass by customs and unique barcodes identify which flight/gate/area the form was handed out at, so we co-ordinate with cameras in the airport and have captured your image.
