and environmental consulting for.poultry processing facilities Clearwater.also provides regulatory compliance.assistance in areas such as permitting.tier 2 and TR eye reporting stormwater.management spill prevention and.enforcement action assistance Sam.graduated from Mississippi State.University in 2006 with a BS in civil.engineering and earned a master's degree.in environmental engineering from.Virginia Tech in 2008 he is a registered.professional engineer he and his wife.Katherine have three children and one.more on the way so he's very busy.clearly Sam thank you very much well.it's a pleasure to be here I get to talk.about something today that I get to do a.whole lot of in the next couple of.months the tier two reports are due.March first and then the t.ri reporting.is due shortly after that on July 1 so.if you haven't already started if this.is part of your responsibility then you.want to go ahead and be pulling together.a lot of this information and preparing.to get those reports in okay so when.Paul asked me to well first of all we're.going to go over so the two separate.reports and so tier twos and for Mars.and about each one we're going to kind.of follow this format so what is it what.are you supposed to report on the on the.form and who must report it does it.apply to you or not what's the purpose.of it just kind of the the general you.know why is it recover why does the.report want to know the things it wants.to know sometimes that's important to.know why the question is being asked in.terms of what you provide and then.finally just kind of the nuts and bolts.of it how do you report that form.correctly okay so when Paul first called.me about this and.he said we'd like you to talk about tier.1s dear twos and then pour Mars and.that's like okay sure.how much fun is like what's a tier 1.anybody know and and I just heard John.talking you know he he mentioned tier 1.tier 2 tier 3 on on bnps tier 1 and tier.twos as far as facility classifications.so you hear that term a lot and anyway.had to do some reading up and a 2 1 is.actually closely related to a tier 2.it's funny at tier 2 aren't actually.required to be submitted by F growth.which is the emergency planning.Community right-to-know Act I came out.in the mid 80s what is required directly.is a tier 1 after you submitted tier 1.then the entities that you submit it to.have the option to request a tier 2 a.tier 2 contains everything that a tier 1.and more and so what states found and.over time it became practical just to go.ahead and issue the tier 2 so for all.practical purposes today forget you had.ever heard me say the word tier 1 we.can't submit those anymore all 50 states.require that that these reports be.submitted on tier 2 forms but but.section 3 1 1 and 3 1 2 they do refer to.tier 1 and tier 2 reports here and there.so just know that when you hear these.reports there for someone.interchangeable and you don't have to go.through a process of do I need to report.one of the other that's pretty much a.tier 2 report and once you're to report.is it's requiring facilities will ever.requires facilities to report the amount.location and type of hazardous chemicals.on site now when I hear hazardous.chemical chemicals on site I'm thinking.you know do we have any TNT uranium you.know sulfuric acid things like that.hazardous things that will kill you real.quick well that's not how it here to.defines hazardous so a tier to report.defines a hazardous chemical as any.chemical you have on site that's.required by OSHA to have an MSDS sheet.on.on site with it and that's a lot of.chemicals it's it's way outside the.bounds of what you would normally.consider hazardous just in kind of.everyday common use of the term.hazardous so these are some examples of.things you might see being reported and.termed as hazardous chemicals on-site.you know a lot of things in that.feedmill list pretty much if you go down.the ingredient list at a feed mill.they've got MSDS sheet books that thick.okay so you're just going through this.if it's got an MSDS sheet and more than.likely if it's at a feed mill they meet.the threshold pretty quickly.okay so processing plants these are some.other chemicals typically included on a.tier two sheet and if you're going to a.facility in doing an evaluation of.whether they need to be doing it here.too the first thing that asked for is.their book of MSDS sheets and then from.there you can go and investigate.quantities on all these things.hatcheries that that's a few things that.that you might see reported at those.sites.okay so thresholds do you need to report.it do you not need to report it what.amount well it depends the first is is.it a hazardous chemical see and as we.said hazardous is anything that requires.an MSDS and then there's another level.of classification that's used called.extremely hazardous substances these are.a little bit more defined commonly term.DHS's and where you find if a chemical.as an EHS is on list of Lists it's kind.of a funny term so but you'll find out.that this is a really really commonly.accessed list that EPA puts out and if.you google a list of Lists this is the.first link that pops up every time okay.and it's a this is just an example of.one of the sheets it's several hundred.pages long.it lists this is not inclusive of all.the chemicals that you might be required.to submit on a tier two that's that's.every chemical that requires an MSDS.there's over.forget the number of chemicals at EPA.set exceeds 500 thousand chemicals but.in any case this list is inclusive of.all of your extremely hazardous.substances or EHS and the way you find.out if you have an EHS is on this the.second column from the left or third.column from the left rather since.Section 302 EHS TP q which is threshold.planting quantity now Congressional.Planet in quantity and Section 302 those.the regulations written for.municipalities and first responders that.those are the regulations that tell them.this is what this is the amount of.chemical that that you have to plan for.so if a site in your jurisdiction has an.amount over this level then you have to.prepare a separate plan and that's not.really up to the poultry industry to do.but because poultry and feed mills and.meat processors they typically have a.lot of these it's typically they're.chemicals that trip the response from.fro municipalities and fire departments.to to have to develop plans to deal with.these chemicals in the event of.emergency so that's why it's relevant to.us so what you do if you have a or what.you think might be an extremely.hazardous substance you would go down.this list and if it has a number then.it's an EHS okay now you'll see several.numbers in this column some say on the.one I have highlighted you have 500 you.go a few lines up from that you see 500./ 10,000 what those are telling the.first responders is the thresholds that.they have to plan for okay and if they.have to plan for it then you have to.report it so in the case of formaldehyde.commonly found at hatchery if you have.over 500 pounds of formaldehyde on-site.at any given time now you may purchase.600 pounds of formaldehyde throughout.the year but if you only have an.inventory at any given time of a hundred.pounds then you're not required to.report formaldehyde you still have the.option to do that you're not required to.but if you haven't extremely hazardous.substance.so down below that let's pick one that's.above 10,000 so above let's see floor.Aurora sill above there says 500 /.10,000 if you have that chemical and.it's at a solid form not a powder more.of a solid block then the threshold.planning quantity is 10,000 pounds but.for an EHS and this is important to.remember if you have an EHS and it's.over 500 pounds you're required to.report it it doesn't matter if there's a.10,000 it doesn't matter if there's a.1,000 if you have over 500 pounds.on-site at any given time of an EHS.you're required to report it on it's.here - okay now if the threshold.planning quantity is lower so boy I.should have looked up to pronouncing it.prints the issue of these before I got.up here floor acetyl chloride has a 10.now your reporting requirement is a 10.for that chemical so Furyk acid is.probably going to have a lower threshold.planning quantity than 500 you know.mercury does I believe of lads going to.so what you're going to do is go down.your list of chemicals on site find the.number and it's either 500 pounds or the.threshold planning quantity whichever is.lower okay so what about triggers.reporting for an EHS 500 pounds or tpq.whichever one is lower and then for all.other chemicals that require an MSDS.sheet 10,000 pounds on-site at any given.time during the year okay so this is.important for tier two's why do we.report to your twos well they answer his.safety.the reason F Crow was passed in the.first place in the 80s was over in India.they had a industrial spill and over.2,000 people died shortly after the US.government enacted época F Kragh to try.to prevent something along those lines.and since then you know they're it's not.just for chemical spills if there's a.fire at the facility if there's any type.of response where people are coming onto.it onto the plant that wouldn't.otherwise be familiar with the plant.they have a way to know what's on-site.and what do we need.be watching for and it allows them to.know these things before it happens.okay so tier 2 reporting it's kind of.boring and it should stay that way.because when tier 2 reporting gets.exciting is when something bad starts.happening either you have a fire and all.of a sudden you're trying to tell first.responders okay we've got sulfuric over.here we've got lead over here you know.all types of things and then there's a.building blazing behind you that's not.the time to be trying to organize you.know where hazardous chemicals are.on-site they need to know that they need.to know that beforehand and it can also.get exciting when these guys show up and.you don't have what you're supposed to.have okay so the best thing you can hope.for is that Tier two reporting and for.more reporting for that matter stay.boring and okay so how do we report on.tier twos well first it depends what.state you're in but the regulations.require that they got to be submitted to.three people three entities the state.emergency response Commission so in.Mississippi where I'm from that's NEMA.the local emergency planning committee a.lot of times those are organized by.county and then a local fire department.now just a few years ago in some states.you had to find the physical addresses.for each one of these entities for each.tier to report that you had to submit.and you had to send them all three.copies of the same letter and and keep a.file on site showing that you had.submitted it to those entities and that.obviously got to be pretty cumbersome so.the trend that was seen is that states.have gone towards having a single.electronic point of the middle and then.the state would be responsible for.dissecting that information to the.entities that need to see it.nevertheless it's always good to know.that the facility that say your local to.fire department actually received your.information from the state that's not.something you necessarily want to assume.even though you may be in compliance you.submitted it to the state you fulfilled.your obligation what's the purpose of.the report it's safety and if they don't.have it then the ultimate purpose of the.report is not really being fulfilled so.if you want to go kind of above and.beyond and it's good you know just to.know.your fire department is and know who to.talk to then that's that's somebody good.to check with okay so these are just.some examples of what states are using.Alabama Mississippi and Arkansas they're.using a software program called tier two.submit we could probably go for about.two hours today just on the software.program and you know you'd still have to.just sit down with it and work with it.it's not it's not super user-friendly.anyway.being a room by yourself the first time.you try to use it so okay so Louisiana.they do everything different they have a.state developed website it's actually.not that bad but you log in and they're.you're you're following with the the.state police which makes everything real.comfortable in Louisiana and then.Georgia they they use a software program.called EPLAN.so there's not really a.one-size-fits-all reporting mechanism.like there is for some other reports.including for Mars for your for your.state's you do need to find out how that.state reports and furthermore you need.to find out how that County reports in.Alabama for example the Alabama.Emergency Management entity they.received ports electronically but you.may call your county and they have a.computer that won't boot up so you need.to send them actually a hard copy of the.software submit --all saved on a CD a.lot of times that happens so it's very.site-specific but what you can do a good.starting point is if you just Google.tier two reporting requirements you'll.come to this list you can click on your.state you can scroll down go to your.state and then it'll have contact.information for all of the local.emergency planning committees you can.get the contact information for them.give them a call.they're usually in the office during the.whole month of February they get a lot.of calls in and and you can find out.exactly what they want and how they want.it okay just a few points when you're.when you're evaluating chemicals keep in.mind that.this is for safety you're not getting.away with anything.if you fall at nine thousand nine.hundred and ninety five pounds and so.you don't have to report it if you're.close there's no penalty for going ahead.and reporting it and you may just avoid.non-compliance when you expected not to.have to ok so especially for hazardous.chemicals put yourself in the.perspective of somebody having to arrive.on-site what would you want to know is.there at facility and then also on the.tier two reports I don't have it listed.up here there's a field for listing the.location of the chemical don't put it's.over by the boiler on the left side if.you're looking at it you're looking.you're trying to describe locations that.are in in terms of somebody who hasn't.visited the facility so ideally what you.want to do is include a site map with.the locations act of the chemicals.actually marked on there and there's a.place to do that on these forms and then.finally you want to keep copies of all.of your submissions ready for both.inspections and just a hand to somebody.if they show up in case of an emergency.don't just have one person who knows.where these reports are because I.guarantee you they'll show up for an.inspection there will be a fire on the.day that person's on vacation so you.want to have several people who know.exactly where they are who know what.they are and know who to where to go to.get it and what they're asking for.okay so shifting gears TRL reporting.toxic release inventory tier 2 s or F.cross section three one two toxic.release inventory is section three one.three it deals with kind of a different.rationale for why we're doing it and it.what it does is it reports the.management and releases of section three.one three chemicals now section three.one three chemicals are included in the.list of chemicals that are that have.MSDS sheets on site but they're much.more narrowly defined and you're.tracking all things about these.chemicals generation use treatment.release and how we define section three.one three chemicals is again go back to.the list of lists there's a column for.section three one three so if you go.down this list and there's a three one.three written by Kim.that you have on site you have a section.three one three chemical if you go down.the list and you look up the chemical.and there's an X in the field by the.chemical that you have on site your.first instinct be might be oh well it.used to be one but it's not one anymore.because they put an X there that's not.true an X just means that it has a.different name somewhere else and it has.a three one three listed by it there so.you still have a section three one three.chemical and and that's not very.intuitive to put an X there but.nevertheless that's what it means if you.see anything in the field you do have a.section three one three chemical okay so.who reports for these section three one.three chemicals on site well it's not.just anybody.poultra if you if you're any type of.food processing industry then you do.report it the way these are grouped is.by SSE codes so find out what your.facility SSE code is for the first three.you are included so if you have a.section three one three chemical it.meets the threshold you need a report if.you're a hatchery it doesn't matter if.you have a section three one three.chemical you don't have to report their.SSI C code is not included that being.said hatcheries don't typically have.enough section three one three chemicals.on site two to warrant reporting okay so.you determine the rule applies to you.you determined that you have section.three one three chemicals on-site.whether they're present by the way this.applies to tier twos as well whether.it's in a mixture in or pure form.it counts okay now if you have a mixture.that's fifty percent of a section three.one three chemical you don't have to.report the entire weight of the mixture.you can calculate out the mass of the.chemical itself and then tabulate that.up and apply to whatever threshold.you're going towards that's worth.mentioning okay so the threshold is.based on how the chemical came to be.on-site and this is not always.real intuitive but basically you have.three categories you have did the.chemical being was the chemical involved.in manufacturing in other words that it.come to be at the site was it a.byproduct of a was it generated on site.is it a product that you're actually.making so it doesn't come on site in the.truck you get the ingredients and you.make the section three one three.chemical okay that would be.manufacturing nitrate is an example of.this it's a you know you get ammonia at.a wastewater treatment system a.biological treatment converts that.ammonia to nitrate you've got your.manufacturing nitrate.okay processing incorporated it into a.product or you're using it in some type.of process but it's not necessarily the.product itself so one one example of.this would be in your chemical program.if you bring in peracetic acid and totes.you use it in chillers it's included in.the processing category and then.otherwise use if they don't fill that.fit into the two categories at the top.then they fit into the bottom one.otherwise you stand one example of that.would be ammonia for refrigeration.you're not using it in the process if.you're using it on the side to complete.some other tasks but it's not you know.it at no point does you know I'm.anhydrous ammonia touch it a bird and.these are the thresholds for each of.these chemicals okay so you would group.together all of your chemicals used for.each of these processes and if that.chemical exceeds this amount then you.report okay so twenty five thousand both.for manufacturing and processing ten.thousand four otherwise use one thing.worth mentioning if you trip the if a.chemical falls into more than one of.these these processes so ammonia is.probably the most common example of this.ammonia is used in refrigeration so in.the form of anhydrous ammonia that would.be in otherwise use if you bring on more.than 10,000 pounds of ammonia in a year.then you trip the threshold but also.you're converting organic nitrogen.ammonia in your wastewater treatment.facility and so you're generating.ammonia that would be manufacturing you.have to exceed 25,000 in that case and.there's some some tricky things about.ammonia in that case as well but if you.trip one of these categories then you.have to report at all.okay so let me give you an example if.you bring on 8,000 pounds of ammonia in.a year to recharge or your refrigeration.system or just from losses whatever then.you don't trip that but you start doing.calculations it's your wastewater.wastewater facility and you go over.25,000 pounds of ammonia generated well.since you trip that now you've got to.report to 8,000 of anhydrous ammonia.that you've brought on site okay so if.you trip any of them you have to report.all of it for that chemical okay so TR.are reporting why do we do it this is.from the EPA kind of a factsheet type.website by making information available.about industrial management of toxic.chemicals available to the public.pri creates a strong incentive for.companies to improve environmental.performance when it came to usage of.chemicals on site rather than going a.what some might call a more traditional.route of saying if you produce a hundred.tons of project product you can use this.amount of chemical and just directly.relating it BPA just chose to take the.direction I'll tell you what will just.make all this information public and.will try to use public perception to.create incentive for the companies to.minimize use okay now there's another.side benefit as companies minimize use.of these chemicals typically you see.costs go down you see liability go down.and so when you complete the TR I report.one thing that it asks you is production.information how what what amount of.business did you do and so what they'll.do for you is they'll normalize the.amount of chemicals that you're.releasing and they'll actually track it.over the course of years and then after.you report they'll show you say your.last three years and they normalized how.much chemical you're using or releasing.to how much product you've been putting.out so it actually gives you some good.company.Meishan as well just to see how you're.doing with waste minimisation TRR.reporting there there is a central place.to report this it's not a state Pacific.specific as tier twos the CDX website.it's used for much more than formal.reporting there's a lot of stuff that.goes into the central data exchange.website and the steps are pretty easy.you'll create a personal user login and.you'll associate your login with your.facility your facility has a try fit a.TR our facility ID and that ID doesn't.change even if the facility changes.ownership once you have a tripod the.tripod sticks with the facility and so.once you're connected with the facility.you're able to report for that facility.and then you would complete and submit.your reports and those reports fall into.two categories.for maize and for Mars okay so a form a.it's much more simple than a form arm.and it doesn't take a near as much time.to complete but it might take some work.on the front end just to make sure that.you qualify to submit a form a and.you've got to meet these two conditions.the total amount manufactured processed.or otherwise used may not exceed 1.million pounds so that means the total.that ever came on site or was used for.anything can't exceed a million pounds.and that's cumulative that's tier two is.what's on site and again at a given.moment for Mars and for maize arm or how.much was used throughout the year so a.total purchasing and then the total.total reportable amount and reportable.is defined as disposed or treated or.recycled it's basically if it's waste.its treated as a waste product.it cannot exceed 500 pounds okay what.falls under for maize are typically.metals that feed mills found in trace.ingredients okay so you don't typically.use more than a million pounds of feed.and you don't typically waste these at.all they're usually incorporated into.the feed and you can do the calculations.to see if you meet these standards what.you'll do is you'll basically find out.an average recipe used throughout that.year and recipes that feed mills change.with respect to trace ingredients so.every year you need to find out what are.we doing with trace ingredients and how.much are we including in feed find out.how much of each of these criteria.metals are included in the trace.ingredients and then you can do your.calculation to see how much went into.product if it's over 25,000 pounds you.report it if it's under 25,000 pounds.and you don't have to okay so for more.chemicals what are they typically at.facilities that we're interested in well.for processors and renderers these are.five that you would typically see there.are others that are kind of.site-specific came across a renderer who.who had a waste wood burning facility.and they actually got into dioxins that.has its own regulation by itself so if.you have any waste wood burning or you.come across the word dioxin and you can.almost be guaranteed you have to report.and you have to report a lot about it.but anyway these are common and then.just some details to cover for each of.these chemicals ammonia when you send a.water sample off and you haven't.analyzed for ammonia you get a report.back says ammonia it might be 30.milligrams per liter well of that 30.milligrams per liter here's what EPA.says you can assume that 10% of that is.reportable as ammonia and what they're.basically saying is that 90% exists in.the form of ammonium nh4 Plus which is.not ammonia so you can get real.technical with these forms and when this.happens then you would just take 10.percent of an ammonia that you get from.a lab report and and then.add that to your little addition see if.you meet the threshold now one thing to.remember is that some ammonia and.treatment plants is caused by blowdown.of anhydrous ammonia which is 100%.reportable from refrigeration systems.that's when you take your ammonia gas.and you would bubble it into water and.it becomes miscible it becomes dissolved.in the water and what you're doing there.is you're converting ammonia as far as.EPA is concerned you're converting her.percent ammonia to 90% ammonium and ten.percent remains as ammonia and the way.you would report that on a form are is.when it asks you how much ammonia did.you treat then that 90 percent that.converted from ammonia to ammonium that.you would put that in there that's.ammonia treated on site okay and one.other thing to mention about ammonia.done at the bottom.in biological treatment you're.converting ammonia to nitrate and so you.wouldn't count this ammonia as being.released that would also be treated.because you're converting it from.ammonia nitrogen to nitrate nitrogen and.and so you're not releasing ammonia but.then you go to the next t.ri chemical.which is nitrate so you're converting.one section three one three chemical to.another and nitrate it's quirky as well.so when you're determining the reporting.the threshold for whether you need to.report nitrate from your biological.wastewater treatment plant on your form.are you calculate the amount of nitrate.produced okay so it falls under the.manufactured category it has to exceed.twenty five thousand pounds but when you.weigh it out you would get your total.nitrate but then you would have to do a.conversion to make that way to make its.nitrate as sodium nitrate which is kind.of a chemistry conversion but typically.you're not typically exactly you're.multiplying at times about one point.three seven and so however much nitrate.you have leaving the facility you need.to measure that.sodium nitrite which increases the.weight of it for the threshold but once.you trip the threshold then you get to.convert it back and report the release.as nitrate just as nitrate okay so you.see this it gets real technical and once.you get you a good spreadsheet made for.it it's it's not that difficult but you.do need to keep track of where your.numbers are going and and how you're.calculating things and also once you.convert ammonia to nitrate so you're.generating that you can treat nitrate by.converting it to nitrogen gas and this.would happen in most treatment.facilities even if you're not.specifically designing it to.denitrifying nitrification in in less.aerated zones within your facility.whether it's designs for that or not so.that can be taken - taken into account.when you report the release for these.chemicals okay.hydrogen sulfide this one's a booger in.prior to 2011 EPA had issued a stay on.hydrogen sulfide it was a section three.one three chemical but EPA said you.don't have to worry about it right now.so in that list which you would have.seen the list of lists you would have.seen a three one three by hydrogen.sulfide but you see a little lowercase s.which means state you don't have to.report it well they took that s out in.2011 and so for reporting year 2012 and.2013 and coming up in 2014 you do have.to report hydrogen sulfide on your form.arm the u.s. poultry and eggs.Association.I believe worked with Warren and how to.and they developed a basically a.calculation that the industry could use.to report hydrogen sulfide hydrogen.sulfide can't be measured coming off an.anaerobic Lagoon not without I mean if.it's capped it could but typically what.you see is a lot of conversion and then.breakdown before you could even measure.it and what trips the threshold it's not.how much you release it's how much is.generated so the the calculation for.what.you need to report hydrogen sulfide gets.very theoretical and you can look at.some documentation that US poultry.poultry and eggs Association has.acquired to to look at that and.basically what it does it gives you.protection and you know their protection.in large numbers and so as an industry.if we all decide well we're going to.report it this way and you know and.we're open to suggestions but when EPA.lifted to stay they didn't give any.guidance on this is how you should.report it so the u.s. poultry and egg.really took a good stance I think on.developing something pretty quickly that.everyone could use so that if if there.becomes a problem with it in the future.at least we're all in the same boat and.until something better comes along then.this is probably a good way to approach.this and finally after this talk I doubt.you could go online and actually just do.a bunch of for Mars and not have a ton.of questions both about the software.about different rules and this is a.really good starting point.EPA has issued guidance for our industry.it's a pretty lengthy document but just.to skim over and had to have it.accessible when you're good when you're.submitting these reports would be a.really good thing also going back to CDX.it's usually contracted out customer.services and on the CDX website when.you're doing for Mars if you have.problems with the online interface which.if you don't then you probably went to.the wrong website you can call them and.even when it's a week before their due.I've never had to wait on hold more than.five minutes and it's usually somebody.very
