Check How to Enter the Colorado Warranty Deed For Husband And Wife To Trust

oh hi sorry I didn't see you there.I was pokemons going just kidding I.totally wasn't doing that hi everyone.I'm attorney Aiden Kramer with the law.office of Aiden Kramer in Colorado and.you're watching all up in your business.today on all up in your business we're.going to venture into the exciting world.of deeds I did a video a long long time.ago about transferring property to an.LLC and in that video the topic of deeds.came up and I asked if you guys wanted.to learn more about the different types.of thieves and many of you said yes so.we're going to talk about all the.different fun types of deeds just for.clarification in case some of you don't.already know.when I you talk about using deeds to.transfer property to an LLC or anything.else I'm talking about real property.which is houses condos townhomes things.you live in that's real property so you.wouldn't use a deed to transfer other.types of property this is talking about.specifically real property there are.many different types of deeds the three.that I'm going to talk about are the.three most commonly used deeds and those.are a general warranty deed which is.also usually just called a warranty deed.a special warranty deed and a quitclaim.deed a general warranty deed is most.commonly used in traditional transfers.of real property you're buying a house.from somebody they're selling their.house usually you use a general warranty.deed in that kind of a transaction the.purpose for that is what a general.warranty deed means is that the seller.or the grantor is Warren teeing or.guaranteeing a few certain things about.the property the seller is guaranteeing.number one that they own the property.they own title to the property and have.the ability to transfer it to you and.they're also guaranteeing that there are.no liens or encumbrances no.debt no negative things that would.affect title to the property they're.saying that they transfer to you free.and clear of all of those issues if any.issues do arise in the future they're.going to pay for you to defend your.title in the property so that's why it's.commonly used in a traditional buy sell.transaction of a house if you buy a.house from somebody and use a warranty.deed to purchase it and then later on.you find that there was an outstanding.debt on the property and now there's a.lien on the property the seller.guaranteed to you that that didn't exist.and now they have to pay and help you.defend your title in the property to.help I've drawn up some very useful and.helpful illustrations of this so here.you can see under a warranty deed the.seller or the grantor is using a.warranty deed to transfer title to the.buyer or the grantee and under this deed.the seller is guaranteeing that it's.free and clear of any encumbrances and.the seller is going to defend title.that's why the buyer looks so happy.because the general warranty deed is.good for the buyer a special warranty.deed is similar to a general warranty.deed with one exception the seller with.a special warranty deed is only.guaranteeing the title to the extent.that the owner owned the property so.that basically means that they're saying.that during the period when the seller.owned the property no issues there were.no encumbrances no liens no debts no.issues on the property that came up.during that period when they owned the.property but they're not guaranteeing.anything about what may have happened.prior to when they took title to the.property so if you take title to a.property through a special warranty deed.and later find out that there's a debt.or some other issue with the title to.the property and it arose before the.seller sold to you before that seller.purchased the property in the first.place then that seller isn't going to.have to.defend your title or really do anything.it's it's out of their hands but if it's.found that the defect in title arose.when the seller was owning the property.then they would have to guarantee and.defend the title in the property and.then finally a quick claim deed quick.claim deeds are very rarely used in.those traditional buy sell transactions.and almost never should be used this is.much more common in something like.transferring property to an LLC or.through a trust or in a divorce.situation for example a couple gets.divorced and the husband will quit claim.deed the property to the wife so what.happens with a quit claim deed is that.there are no guarantees no warranties.whatsoever with the property that's why.the buyer doesn't look too happy because.he's kind of unsure what this whole.thing is if there's an issue with title.after you purchase it using a quitclaim.deed or after you take possession and.ownership of it via a quitclaim deed you.have no recourse whatsoever to the.seller or the grantor whoever gave you.the property with a quitclaim deed.they're not even guaranteeing that they.own the property it could just be some.Joe Blow walking down the street handing.out quick claim deeds they can do that.doesn't mean anything because he's not.saying he owns the property he's just.eating out properties willy-nilly to.everybody and for the record just so.we're all clear and on the same page.it's quit claim deed not quick claim.deed I hear a lot of people saying quick.claim but it's not quick it's quick quot.whether or not it's one or two words.though quick claim or quit claim I'm.still not sure I'm pretty sure it's one.word but I think one of great life's.great mysteries I guess no one will ever.know so because of the differences in.those types of deeds and the effect that.they can have on the title of the.property it's always best to work with a.real estate lawyer when you're dealing.with any transaction related to real.estate or real property using the wrong.kind of deed can cause hiccups or issues.in the title to the.property down the line and it could.affect you directly or it could affect.you after you've sold or gotten rid of.the property but typically typically not.always but in many cases using a.quitclaim deed to deed property from.yourself into an LLC will be okay don't.take my word for it though.that's just usually the case but it's.going to vary substantially depending on.your specific circumstances and the.circumstances surrounding the property.that you're going to be transferring so.because of that don't rely on what I'm.saying work with a real estate attorney.to make sure that's the right way to do.it I hope that helped to clear up some.of the confusion between the different.types of Deeds it is confusing and I.even myself sometimes still get confused.even though I work with them quite often.if you're in Colorado and are looking.for assistance with transferring a.property to an LLC you can of course.contact me my phone number and email are.below thank you all so much for watching.I'm Aiden Kramer and I'll see you next.time.look you guys I can't one I caught a.pokeyman you look very nice so I'm gonna.throw him back I think.

Do military members have to pay any fee for leave or fiancee forms?

First off there are no fees for leaves or requests for leave in any branch of the United States military. Second there is no such thing as a fiancée form in the U.S. military. There is however a form for applying for a fiancée visa (K-1 Visa)that is available from the Immigration and Customs Service (Fiancé(e) Visas ) which would be processed by the U.S. State Department at a U.S. Consulate or Embassy overseas. However these fiancée visas are for foreigners wishing to enter the United States for the purpose of marriage and are valid for 90 days. They have nothing to do with the military and are Continue Reading

I received my late husband's W-9 form to fill out for what I believe were our stocks. How am I supposed to fill this out or am I even supposed to?

You do not sound as a person who handles intricasies of finances on daily basis, this is why you should redirect the qustion to your family’s tax professional who does hte filings for you. The form itself, W-9 form, is a form created and approved by the IRS, if that’s your only inquiry. Whether the form applies to you or to your husband’s estate - that’s something only a person familiar with the situation would tell you about; there is no generic answer to this.

In New York, if a husband, wife, and a mutual friend each have their names on a deed to a house, can the friend force the couple to buy him out of the deed?

You would need to consult an attorney on the specifics, but I would imagine yes. If the friend has any equitable interest in the property, he/she could try to take this to court to get his/her interest out of the property. Again, I would refer to an attorney.

What happens to all of the paper forms you fill out for immigration and customs?

Years ago I worked at document management company. There is cool software that can automate aspects of hand-written forms. We had an airport as a customer - they scanned plenty and (as I said before) this was several years ago... On your airport customs forms, the "boxes" that you 'need' to write on - are basically invisible to the scanner - but are used because then us humans will tend to write neater and clearer which make sit easier to recognize with a computer. Any characters with less than X% accuracy based on a recognition engine are flagged and shown as an image zoomed into the particular character so a human operator can then say "that is an "A". This way, you can rapidly go through most forms and output it to say - an SQL database, complete with link to original image of the form you filled in. If you see "black boxes" at three corners of the document - it is likely set up for scanning (they help to identify and orient the page digitally). If there is a unique barcode on the document somewhere I would theorize there is an even higher likelihood of it being scanned - the document is of enough value to be printed individually which costs more, which means it is likely going to be used on the capture side. (I've noticed in the past in Bahamas and some other Caribbean islands they use these sorts of capture mechanisms, but they have far fewer people entering than the US does everyday) The real answer is: it depends. Depending on each country and its policies and procedures. Generally I would be surprised if they scanned and held onto the paper. In the US, they proably file those for a set period of time then destroy them, perhaps mining them for some data about travellers. In the end, I suspect the "paper-to-data capture" likelihood of customs forms ranges somewhere on a spectrum like this: Third world Customs Guy has paper to show he did his job, paper gets thrown out at end of shift. ------> We keep all the papers! everything is scanned as you pass by customs and unique barcodes identify which flight/gate/area the form was handed out at, so we co-ordinate with cameras in the airport and have captured your image. We also know exactly how much vodka you brought into the country. :)

I am filing for a divorce, and I don't want child support from my wife. Is there a form to fill out?

It is impossible for anyone to answer your question without knowing where you live. Divorce procedure is different in each country, and in each state in the US. In Pennsylvania, child support is entirely separate from divorce filings, so you wouldn’t have to fill out any forms regarding support unless you’re asking for support. Where you live, I have not a clue. You should contact a lawyer where you live and make sure you’re doing things correctly.

Do soldiers need their wife, girlfriend or fiancee to recuest for them to come home? Do they need a form to fill out and pay $2,600 with the form?

This is a scam. No army personal pays for leaves or vacations. All military men and women don't have time to be chatting with anyone on internet. But they can video chat .text family.on there free time.

Why don't schools teach children about taxes and bills and things that they will definitely need to know as adults to get by in life?

You Don't Get The Premium Channels Because they are not the children of the School nor of the State, they are citizens. While it is necessary, it is not done because YOUR family should do this for you, should be making an effort to understand how. The assumption that school is to teach a person about the immensity of life is ridiculous and one of the ways that society leans on school (government) rather than self-empowerment. You get what you pay for. If school is a free public service than you can’t have the premium channels. Now that omission might screw up the usage of those skills but schoo Continue Reading
