the Sun is about to go downhere and I'm standing on the bridgeright here on over the river it's justgorgeous here it really is and anyway solet's talk about the topic real quickgetting distracted by the beautifulsurroundings here so let's talk aboutthis how should she purchase tax salesso first off when Pat sent in questionto me I had to basically just clear up afew things for starters a contract asales and purchase contract for a pieceof real estate is really just a promisethat you are agreeing to purchase aproperty for a specific price by aspecific amount of time and with aspecific way of conveyance which is howthe property and its title is going tobe transferred sothe contract itself has really notnecessarily something to do with howit's conveyed even though they'rerelated so I'm gonna try to clear thisup a little bit so contract is basicallyjust a sales contract could be a onepage it could be 20 pages if youpurchase a home through a realtor Idon't have contracts that are 20 30pages long with all kinds of extraencumbrances and notes and everything inthere that you may need actually andrealto will be able to explain those toyou really well but i'm not a realtorjust mind you I'm a real estate investorso I kind of do things the easy waynon confusing way the way that hopefullyeverybody can understand so using aone-page contract is in most cases isfine if you wanted to maybe add a coupleof notes to that contract as in makesure that the seller sells to you theproperty of every part of the propertythat they own for example don't sell youninety-five percent of the property youreally pretty much write anything youwant in a contract and I've seenactually people sell properties realestate for not a hundred percent of thereal estate but just 95 percent of it orninety percent of it and this is themfor specific purposes I'll go into thisin another video sometime it hassomething to do with how a mortgage canbe transferred so a lot of mortgagesactually prohibit you to sell a propertywithoutview mortgage paying off your mortgagefirst but if you sell the property not ahundred percent of it but part of itlike 95% or 99% then you can justcontinue to hold the mortgage and themortgage company really can't doanything about it you might hold anothertopic I'll get to that kittensidetracked here but um anyways back tothe sales contract it could be aone-pager it could be 1015 pageswhatever you want to write in a contractit's basically just an agreement betweenyou the buyer and the seller on how youguys are gonna do this transaction oftransferring the property from them touse or vice versa so that's what acontract is when you're talking aboutselling a property by a quitclaim deednow now you're talking about conveyanceso there's a whole different set of waysof how you can make a property it could1be very quick claim deed it could be1with fee simple it could be with a1warranty deed it could be a lease1purchase option it could be just a1number of ways how you actually transfer1the property the legal way of transfer1now if you have an attorney and I would1very highly recommend that you get one1on your team you can ask them all those1questions quite honestly I'm not an1attorney I can understand and do all the1work that an attorney does but I for my1deals I you still use an attorney1because it's just more convenient for me1they do it the right way and quite1honestly it saves me a lot of time and1effort and gives me the insurance that1it's done correctly so get an attorney1on your team that can explain to you the1different ways of conveyance but let me1just give you a brief summary what you1need to be looking for if you're1transferring a title as the buyer you1want to make sure that you get1everything that you can possibly get the1best possible title of a property so a1hundred percent of the property1everything they sell1can sell that they'll transfer that to1you now they can do that with a1quitclaim deed but notice that with the1quitclaim deed they're only conveying1the interest that they have in a1property so let's say the Bayeux1purchased the property at a tax sale and1you're buying this property from them1you're really only getting their1interest so there might be other lien1holders and mortgages or other1conveyances maybe some easements or1something like that so all of that you1are so responsible for and most1importantly the seller is not going to1guarantee the title so if you're buying1a property via quitclaim deed it is1really really important that you do a1title search either yourself or hire a1title search company to do it for you if1you hire an attorney they will have a1service that comes along with their1closing usually they kind of farm that1out hire that out to do a title search1for you or they'll give you all the1information that you need to know on in1terms of what it is that you're actually1buying if there's any kind of1encumbrance of said you need to worry1about so again I'm sorry to get back to1this but you probably are better off to1get an attorney to do a closing for you1instead of doing it yourself now let me1just give you just to close up this1video because we're going for quite a1ways I want to kind of show you the1surroundings here's actually quite1beautiful here on the moldovia River1in my personal life I have used1attorneys and I have sold and bought1properties by a quitclaim deed mostly1just sold him by quitclaim deed I try1not to buy properties with could claim1deeds because I just want to be sure1that the property that I get is a1hundred percent solidly the sellers to1sell to me so there's no problems not1gonna be any problems with the title1anytime in the future so um in my recent1years I've started using attorneys more1often and pretty much for everything but1if it's just a simple sales contract and1I've done the title search and there1wasn't anything there I say the property1was sold to me by a seller who's had the1property in the family for thirty years1there's really nothing else in the1property records no liens or anything1you can see that by just checking the1property records yourself then you can1be pretty fairly sure that could claim1data spine and save yourself some1attorney costs if you want to so I'm1kind of have to just wage your risks1there so if the property is very1expensive costs you thousands of dollars1just hire to train you to it but if1you're just doing the quitclaim deed for1property that's only a thousand dollars1doesn't make much sense to get an1attorney to do the closing for another1thousand you know just doesn't make much2sense so kind of just weigh your risks2your advantages disadvantages in hiring2an attorney but also try to learn what2the attorney actually does so you can2decide for yourself whether it's2worthwhile to do the work yourself or if2you should hire somebody but definitely2do understand the difference that a2contract is not the same as a vehicle of2conveyance2so a regular sales contract a one-pager2is not the same as a quitclaim deed or a2warranty deed security deed or any of2those other actual conveyance documents2there are legal documents that are filed2at the courthouse and in most cases2during a closing you have to have both2so just kind understand the difference2if you don't know make sure you go to2let or look at other youtube
